این قوانین API گیلاس، شرایط و قوانین استفاده شما از رابط‌های برنامه‌نویسی کاربردی گیلاس را مشخص می‌کند. با استفاده از رابط‌های برنامه‌نویسی کاربردی گیلاس، شما به این قوانین API رضایت می‌دهید.
استفاده از گیلاس و رابط‌های برنامه‌نویسی کاربردی آن نیز مطابق با شرایط خدمات گیلاس و حریم خصوصی ما است. به معنای این ترم‌ها، “API” به هر رابط برنامه‌نویسی کاربردی ای است که توسط گیلاس ارائه شده و هر داده مرتبطی که از طریق API ارائه شده باشد. تمامی اصطلاحات بزرگی در این قوانین API به معنای تعریف شده در شرایط خدمات هستند، به‌جز در موارد دیگری که اظهار شده باشد.
در صورت بروز تضاد بین قوانین API و شرایط خدمات گیلاس، قوانین API اولویت دارد.

برای استفاده از رابط برنامه‌نویسی کاربردی گیلاس، شما باید به مستندات توسعه‌دهنده ما پایبند باشید و هر مستند دیگری که ما ارائه می‌دهیم.
سیاست‌ها #
شما باید به سیاست‌های ما پایبند باشید، از جمله رهنمودهای استفاده ما و هر قانون یا مقررات مربوطه در هر زمان.
ممنوعیت استفاده دولتی #
خدمات ارائه شده از طریق رابط‌های برنامه‌نویسی کاربردی ما به صورت سختگیرانه برای استفاده شخصی و تجاری مختص است. تحت هیچ شرایطی این خدمات نباید توسط هیأت دولتی، نهاد، یا هر فردی که به نمایندگی از یک هیأت دولتی عمل می‌کند، مستقیم یا غیرمستقیم، برای هر منظوری استفاده شود. این ممنوعیت تا استفاده از رابط‌های ما برای منظورهای مستقل، از جمله امور حکومتی، اجرای قوانین، جمع‌آوری اطلاعات استخباراتی، یا هر فعالیتی مربوط به استفاده از قدرت، اختیارات یا عملکردهای دولتی، ادامه دارد. هر گونه تلاش برای استفاده از رابط‌های ما برای چنین منظورهایی، سهیم مستقیم یا غیرمستقیم از طریق دسترسی مستقیم یا غیرمستقیم از طریق شخص ثالث، به‌طور صریح ممنوع است. نقض این ماده به منزله پایان فوری خدمات است و ممکن است منجر به اقدامات قانونی برای اجرای اطاعات و بازپرداخت خسارات شود. کاربران موظف‌اند اطمینان حاصل کنند که استفاده آن‌ها از رابط‌های ما با این محدودیت مطابقت دارد و در صورت آگاهی از هرگونه استفاده دولتی از خدمات ما، به‌صورت مستقیم یا از طریق هر میانجی، به‌طور فوری به ما اطلاع دهند.
لایسنس #
الف. لایسنس به شما
با رعایت شرایط این ترم‌ها، ما به شما یک لایسنس محدود، غیر انحصاری، غیر قابل انتقال، غیر قابل اجاره، غیر قابل اجاره، قابل لغو برای دسترسی به رابط‌ها و مستندات فقط برای توسعه، ادغام و عملکرد بر روی پلتف

ج. بازخورد

حریم خصوصی #
در صورتی که داده کاربری‌ای که از طریق رابط‌های ما دریافت می‌کنید حاوی داده شخصی باشد، شما باید: (a) با تمامی قوانین حمایت از داده‌ها مطابقت داشته باشید و فقط از این داده‌های شخصی طبق سیاست حریم خصوصی گیلاس استفاده کنید، (b) داده‌های شخصی را به محض درخواست یک کاربر (یا توسط ما به‌نیابت از یک کاربر یا نماینده مجاز او) یا طبق قانون حذف کنید، (c) تدابیر امنیتی فنی و سازمانی قوی برای حفاظت از این داده‌های شخصی از دسترسی، استفاده یا افشا غیرمجاز اعمال کنید، (d) در صورت وقوع نقض داده‌های کاربری گیلاس وقتی که داده‌های کاربری گیلاس وقتی که داده‌های کاربری گیلاس دچار نقض شود، به ما در عرض 48 ساعت اطلاع دهید و اقدامات مناسب برای کاهش را انجام دهید و (e) داده‌های شخصی کاربر را فروش نکنید. شما و گیلاس به‌عنوان کنترل‌کننده‌های داده مستقل عمل می‌کنید.
محرمانگی #
اطلاعات محرمانه ما شامل هر مواد، ارتباطات و اطلاعاتی است که به‌طور مشخص محرمانه مشخص شده‌اند و یا به‌طور عادی تحت شرایط مشخص محرمانه در نظر گرفته می‌شوند (شامل هر گونه اطلاعات غیرعمومی). این ممکن است شامل ارتباطات ما با شما، رابط‌های ما، مشارکت شما در نظرسنجی‌های بازخورد، آزمایش‌ها و هر استفاده دیگر از یا رابط‌هایی که به شما ارائه می‌دهیم و

پایان #
شما یا ما می‌توانیم این ترم‌ها را در هر زمان با ارسال اطلاع قبلی 30 روزه به طرف دیگر خاتمه دهیم.

بدون محدودیت در زمینه‌های فوق، حداکثر مسئولیت تجمعی گیلاس نسبت به شما برای زیان یا خساراتی که به‌دلیل استفاده از رابط‌ها یا خدمات گیلاس یا این ترم‌ها برایتان ایجاد می‌کنید، محدود به 10 دلار است.
گیلاس، ویژگی‌ها، خدمات و رابط‌های آن به‌صورت “چگونه هستند” ارائه می‌شوند. ما نمی‌توانیم تضمین کنیم که هرگونه ربات، رابط برنامه‌نویسی کاربردی، ویژگی یا خدمات گیلاس یا موجود در گیلاس در دسترس خواهند بود. در حالی که ما به‌صورت مداوم در حال توسعه ویژگی‌های جدید هستیم، ممکن است بدون اطلاع قبلی از شما، ویژگی‌های جدید را اضافه یا حذف کنیم، استفاده یا دسترسی به ویژگی‌ها و رابط‌ها را کاهش دهیم یا به‌طور کلی بسته‌ها را ببندیم اگر موجب ایجاد ریسک برای گیلاس، کاربران گیلاس، شخص ثالث نشوند، دیگر از دیدگاه تجاری معنی نکند یا به هر دلیل دیگری در اختیار ما قرار گرفته است. همچنین نمی‌توانیم تضمین کنیم که استفاده شما از گیلاس یا رابط‌های آن بدون خطا، قطع یا عدم تجربه خدمات نخواهد بود. ما مسئول هیچ گونه خطا، قطع یا اختلال خدماتی نیستیم که ممکن است رخ دهد.
جبران خسارت #
شما متعهد می‌شوید که ما، فرع
ی‌های ما و پرسنل ما را در برابر هرگونه ادعاها، زیان‌ها و هزینه‌های شخص ثالث (شامل هزینه‌های وکالت) از طریق کاربری‌های شما با استفاده از رابط‌های برنامه‌نویسی کاربردی گیلاس، از جمله استفاده از داده‌های دریافتی از طریق رابط‌ها و نقض این ترم‌ها یا قانون مربوطه، دفاع کنید و بدون تضمین ما، بی‌اشتراک کنید.
اصول قانونی عمومی #

These Gilas API Terms حریم خصوصی set forth the terms and conditions of your use of the Gilas APIs. By using the Gilas APIs, you consent to these API Terms.
Use of Gilas and its APIs is also subject to the Gilas Terms of Service, as applicable, and our Privacy Policy. As used in these Terms, “API” means any application programming interface made available by Gilas and any related data provided through the API. All capitalized terms in these API Terms have the same meaning as set forth in the Terms of Service, except as otherwise noted.
In the event of a conflict between the API Terms and the Gilas Terms of Service, these API Terms shall control.
Documentation #
To use the Gilas API, you must adhere to our Developer Documentation and any other documentation we make available.
Policies #
You must adhere to our policies, including our Usage Guidelines, and any applicable law or regulation at all times.
Prohibition of Governmental Usage #
The services provided through our Application Programming Interfaces (APIs) are strictly reserved for private and commercial use only. Under no circumstances shall these services be used by any governmental entity, agency, or any individual acting on behalf of a governmental entity, directly or indirectly, for any purpose. This prohibition extends to the use of our APIs for sovereign purposes, including but not limited to governance, law enforcement, intelligence gathering, or any activity pertaining to the exercise of state power, authority, or functions. Any attempt to utilize our APIs for such purposes, whether through direct access or indirectly through third parties, is expressly forbidden. Violation of this clause will result in immediate termination of service and may lead to legal action to enforce compliance and recover damages. Users are required to ensure that their use of our APIs complies with this restriction and to immediately inform us if they become aware of any governmental use of our services, directly or through any intermediary.
License #
a. License to You
Subject to your compliance with these Terms, we grant you a limited, non-exclusive non-transferable, non-sublicensable, revocable license to access the APIs and Documentation solely as needed to develop, integrate, and operate on the Gilas platform. We reserve all rights not expressly granted and you may only access APIs and Documentation as stated herein.
b. License Restrictions
You will not (nor permit or enable others to): (a) use the APIs other than permitted by these Terms, the Documentation or our policies, (b) modify, create derivative works, copy, reproduce, redistribute, rent, lease, sell, syndicate or otherwise provide access to the APIs; (c) reverse engineer or otherwise derive source code, trade secrets, or know-how from the APIs; (d) submit any viruses, worms, Trojan horses, malicious prompts, or other harmful code to Gilas via the APIs, (e) attempt to interfere with the proper working of the APIs or Gilas or compromise their integrity or security; or (f) exceed any API rate, call, or other usage limits we set in our sole discretion (including as set forth in the Documentation) or that we believe constitutes excessive or abusive usage.
c. Feedback
If you provide feedback or suggestions on our APIs, we may freely use that feedback without any obligation to you.
Privacy #
To the extent any user data you receive through the APIs contains personal data, you will: (a) comply with all applicable data protection laws and only use such personal data in accordance with the Gilas Privacy Policy, (b) promptly delete the personal data when requested by a user (or by us on behalf of a user or their authorized agent) or as required by law,(c) implement strong technical and organizational security measures to protect such personal data from unauthorized use, access, or disclosure, (d) notify us within 48 hours in the event of a data breach that involves Gilas user personal data and take appropriate steps to mitigate, and (e) not sell user personal data. You and Gilas will operate as independent data controllers.
Confidentiality #
Our confidential information includes any materials, communications, and information that are marked or designated confidential or that would normally be considered confidential under the circumstances (including any nonpublic information). This may include, our communications to you, our APIs, your participation in feedback surveys, testing and experiments and any use of or APIs we make available to you that are not generally publicly available. If you receive any of our confidential information, then you (i) will keep it confidential using no less than reasonable care to protect it, (ii) will only use it as necessary for your permitted use of the APIs under these Terms and to provide us feedback, and (iii) will not disclose it to any third party without our prior written consent, except to the extent required by law with reasonable prior notice to us unless prohibited by court order.
Termination #
You or we may terminate these Terms at any time by providing the other party with 30 days prior written notice of termination.
You or we may also terminate these Terms immediately if required to do so by law, or if either of us determines that continuing under these Terms could result in legal or business liability or cause harm to our products, services, reputation or users. We may also terminate these Terms or suspend access to the APIs immediately if you breach these Terms or our policies.
Upon termination, you will cease using the APIs. When the Terms come to an end, those terms that by their nature are intended to continue indefinitely will continue to apply.
Disclaimers & Limitation of Liability #
WITHOUT LIMITING THE FOREGOING, GILAS’S MAXIMUM AGGREGATE LIABILITY TO YOU FOR LOSSES OR DAMAGES THAT YOU SUFFER RELATED TO OR ARISING OUT OF YOUR USE OF THE APIs or GILAS SERVICES OR THESE TERMS IS LIMITED TO $10.
GILAS, ITS FEATURES, SERVICES AND APIs ARE PROVIDED “AS IS.” WE CANNOT GUARANTEE THE AVAILABILITY OF ANY BOTS, APIs, FEATURES OR SERVICE OF GILAS OR AVAILABLE THROUGH GILAS. WHILE WE ARE CONTINUING TO DEVELOP NEW FEATURES, WE MAY, WITHOUT NOTICE TO YOU, ADD OR REMOVE FEATURES, LIMIT USE OR AVAILABILITY OF FEATURES, APIs ENTIRELY IF THEY CREATE RISK TO GILAS, USERS OF GILAS, THIRD PARTIES, NO LONGER MAKE SENSE FROM A BUSINESS PERSPECTIVE OR FOR ANY REASON IN OUR SOLE DISCRETION. WE ALSO CANNOT GUARANTEE THAT YOUR USE OF GILAS OR ITS APIs WILL BE ERROR FREE, DISRUPTED OR THAT YOU WILL NOT EXPERIENCE SERVICE OUTAGES. WE ARE NOT LIABLE FOR ANY ERRORS, DISRUPTIONS OR SERVICE OUTAGES THAT MAY OCCUR.
Indemnification #
You will defend, indemnify, and hold harmless us, our affiliates, and our personnel, from and against any third-party claims, losses, and expenses (including attorneys’ fees) arising from or relating to your applications using Gilas APIs, including your use of data received through the APIs, and your violation of these Terms or applicable law.
General Legal Terms #
These Terms do not create any third party beneficiary rights or any agency, partnership, or joint venture. Nothing in the Terms will limit either party’s ability to seek injunctive relief. We are not liable for failure or delay in performance to the extent caused by circumstances beyond our reasonable control. If it turns out that a particular term is not enforceable, this will not affect any other terms. The Terms are the entire agreement between you and GILAS relating to its subject and supersede any prior or contemporaneous agreements on that subject.
You may not assign, sublicense, or delegate any of your rights or obligations under the Terms (including any sale, license, or other transfer of ownership of Your Bot) to any third party without our prior written consent. Any assignment, sublicense, or delegation in violation of this provision is null and void. Any change of control or material ownership of you is hereby deemed an assignment. These Terms are non-exclusive. You acknowledge that GILAS may develop products or services that may compete with, or are similar to, Your Bots or any other products or services.
We may change these Terms from time to time, with or without prior notice to you. If you continue to access or use the APIs after the changes have taken effect, it means that you agree to the changes. If you do not agree, you must stop using the APIs.
